Agreement to Terms

By downloading, installing, or using Hush ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and DiscreteZero ("Company," "we," "us," or "our").

Description of Service

Hush is a privacy-focused AI assistant that processes conversations locally on your device. The App offers:

• Hush Mode: A friendly AI assistant interface
• Classified Mode: An enhanced security interface (Pro feature)
• On-Device AI: Conversations processed locally, not on remote servers
• Privacy Features: Including conversation clearing, decoy modes, and security controls

Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use Hush. By using the App, you represent that you meet this age requirement.

Account and Subscription

Acceptable Use

You agree not to use Hush to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to circumvent any security features or usage limits
• Reverse engineer, decompile, or disassemble the App
• Use the App in any way that could damage, disable, or impair our services
• Violate any applicable local, state, national, or international law

We reserve the right to terminate access for users who violate these terms.

Intellectual Property

The App, including its design, features, and content, is owned by DiscreteZero and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Privacy

Your privacy is important to us. Our Privacy Policy explains how we handle your information. By using Hush, you agree to our Privacy Policy.

AI-Generated Content

Hush uses artificial intelligence to generate responses. You acknowledge that:

• AI responses may not always be accurate, complete, or up-to-date
• You should not rely on AI responses for medical, legal, financial, or other professional advice
• You are responsible for how you use AI-generated content
• AI responses do not represent the views or opinions of DiscreteZero

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or completely secure.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISCRETEZERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your device
• Any content or conduct of any third party
• AI-generated responses or content

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless DiscreteZero, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

Modifications to Service

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Providing notice in the App for significant changes

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Florida.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DiscreteZero regarding your use of the App.
